What You Need for a Successful Remote Online Notarization

Interstate Recognition: New York law explicitly recognizes notarial acts performed by out-of-state notaries public under Real Property Law § 299. Per Senate Bill S2271 (effective 2024), New York has eliminated the requirement for a "Certificate of Conformity." Out-of-state notarizations are now prima facie evidence of validity, provided they comply with the laws of the notary’s commissioning state.
Technology & Security: Our sessions are hosted on a secure, encrypted platform utilizing multi-factor identity proofing (KBA), credential analysis of government-issued IDs, and high-definition audio-video recording. These security measures align with the digital integrity and 10-year recording retention standards set forth in NY Executive Law § 135-c, ensuring your New York records are verifiable and tamper-evident.

Remote Disclosure: In accordance with New York standards, my notarial certificate will include the mandatory statement: "This electronic notarial act involved a remote online appearance involving the use of communication technology."
Papering Out: For documents that must be filed in paper form (such as with a County Clerk), I can provide a certified copy of the electronic record as permitted under NY Executive Law § 135-c(6)(d).
Acceptance: Always confirm with your receiving agency (Lender, Title Company, or County Clerk) that they accept out-of-state electronic notarizations for your specific transaction.
