Swift Key Notary

Terms & Conditions for Services
 
This Agreement governs the services provided by Swift Key Notary ("we," "us," or "our") to you, the client ("you" or "Client"). By booking, scheduling, or using any of our services, you agree to be legally bound by these Terms and Conditions. This document applies to all services offered by Swift Key Notary, including mobile notary, remote online notarization, document translation, and photo inspection services.

 
General Terms
 

  • Pricing and Payment All in-person notary services are provided at a single, all-inclusive fee that is agreed upon before you book. The final fee includes the notary's time, travel, and any administrative costs. For all other services, a payment link will be provided to confirm the services by advanced payment. All quotes are valid for two hours from the time they are provided. Payment is required before any service is traveled to or rendered.

  • Cancellations and Reschedules We maintain a strict schedule to ensure timely service for all clients.

    • Rescheduling We allow rescheduling with at least 24 hours’ written notice to sarah@swiftkeynotary.com. While we will do our best to accommodate your new time, no refunds will be issued if we are unable to meet your exact rescheduled time.

    • Cancellations All services are non-refundable once paid unless canceled in writing to sarah@swiftkeynotary.com at least 24 hours prior to the requested appointment time.

      • Cancellation Fee Any cancellation or reschedule request received within 24 hours of the scheduled appointment is subject to a cancellation fee of up to 50% of the original quote. If a cancellation or reschedule is requested within two hours of the appointment, the client is responsible for full payment, especially if the contractor has already begun travel to the location.

  • Chargebacks and Disputes By agreeing to these terms, you understand and agree that we will provide this Agreement to your credit card provider in the event of a chargeback dispute. You also agree to pay all fees and costs related to such disputes.

  • Limitation of Liability Swift Key Notary is a notary service. We are responsible for the scheduling and proper delivery of the service as defined in this Agreement. Our maximum liability shall not exceed the total amount paid by you for the specific service purchased.


 
In-Person Notary Services
 

  • On-Time Appointments For an appointment to be considered on time, the client and all signers must be present and ready to proceed within 15 minutes of the scheduled appointment time. This includes signers who refuse or are unable to sign. If the notary is delayed, they will make every effort to notify you promptly.

  • Identification Requirements All signers must have proper identification for a notarial act to be performed. Examples of acceptable forms of identification include:

    • A valid, unexpired Driver's License or non-operating identification license issued by a U.S. state or territory.

      • In Missouri, 2 Credible Witnesses (people who knows you, are NOT related to you, and have acceptable IDs) may be used.​

    • A valid, unexpired U.S. Passport.

    • A valid, unexpired Armed Forces Identification Card.

    • A valid, unexpired U.S. Permanent Resident Card (Green Card).

      • Improper identification or a delay of more than 15 minutes in providing identification will result in cancellation without a refund. We cannot accept a foreign passport.

  • Signer Requirements Signers must be coherent and willing to sign the document. Signer must be able to understand the document they are signing, and understand the terms of that document. If a notary is not comfortable performing the notarial act because a signer is unwilling or incoherent, the appointment will be canceled and no refund will be issued.


 
Remote Online Notarization (RON)

  • ID Requirements & Verification ID requirements may vary by state, but all states require a valid, non-expired U.S. Driver’s License or U.S. Passport. Foreign passports are not accepted. During your RON session, you will be required to verify your identity using both of the following methods:

    • Knowledge-Based Assessment (KBA): A series of multiple-choice questions based on public records. You must answer at least 4 out of 5 questions correctly to pass.

    • State ID Verification: The platform will not only ask you to upload your current ID, but I will also need to see it during our session. A photo of the ID is NOT permitted, it must be the physical ID itself.

      • Biometrics: Biometrics is not currently recognized by the State of Missouri as a valid form of legal identification verification.

  • Document Acceptance A RON session is considered complete when the notarized electronic document is delivered to you. The notary cannot guarantee that any third party, such as a foreign government, embassy, school, or court, will accept an electronically signed document.

    • Real Estate Documents: It is your responsibility to ensure that real estate documents are pre-approved for a RON transaction by the lender, title company, and the county where the property is located before booking a session. No refunds will be issued if a document is rejected.

  • Technical Issues You are responsible for having a reliable internet connection, a working webcam, and a microphone. If a technical issue prevents the session from being completed, you are responsible for rescheduling. The rescheduling fee may be waived if the issue was clearly due to a failure on the notary’s end.


 
Document Translation Services

  • Scope of Services We partner with a network of professional translators. Our certified translations are intended for use with domestic and foreign governments, including for immigration, legal, academic, and business purposes.

  • Process and Certification Once your translation quote is approved and paid, work begins immediately. All certified translations are delivered with a Certificate of Translation issued on the translator's letterhead. All certifications are notarized by a Missouri-based notary. Our translators are obligated to provide a correct and professional interpretation of the original content. We do not accept directive instructions from clients on how a translation should be rendered.

  • Refunds Due to the customized nature of these services, all sales are final once translation work has begun.


 
Photo Inspection Services

  • Purpose and Scheduling Photo inspection services are primarily for home loan purposes. Appointments must be scheduled during working, daylight hours, between 8:00 AM and 6:00 PM. No exceptions will be made to this schedule.

  • Property Access and Safety You are responsible for creating safe access to the property. Our contractors will not enter properties deemed non-serviceable due to safety, health, or sanitation issues, with photographic proof of inability to service. Examples include hoarding, aggressive animals, or dangerous conditions. In such cases, no refund will be issued.

  • Service Completion Swift Key Notary is responsible for scheduling the contractor and ensuring the final report is properly delivered to you. You are responsible for securing the location and permission for the photography. Special requirements may incur additional fees.


 
Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Missouri without regard to its conflict of law principles.

Notaries are not attornies and therefore cannot practice legal advice.  When it comes to Remote Online Notarization it is up to the signer to ask the receiving party if electronic signatures will be accepted on the document as well as electronic notarizations. Certain documents and types of signings in certain States may not be accepted. Please note that rejected documents, if executed properly, will not be refunded if you have not checked with your receiving party ahead of time. 

🔒 Privacy Policy & Document Handling Procedures

This policy outlines how Swift Key Notary, owned and operated by Sarah Kienzle (referred to as "we," "us," or "our"), collects, uses, secures, and retains your personal information and documents in accordance with state and federal laws.
 

  • Information Collection  We collect personal information to fulfill our scheduling, legal, and payment obligations. The types of personal information collected include:

    • Identifiers: Full Name, Physical Address, Email Address, Phone Number.

    • Notary Record Information: Date of Birth, Government-Issued Identification numbers (from Driver's Licenses, Passports, etc.), and an image of the valid ID for RON.

    • Financial Data: Billing and transaction information (processed by secure third-party payment providers).

    • Digital Information: IP Addresses (for Remote Online Notarization), Location data (for mobile services), and website analytics data (to improve service).

 

  • How We Use Your Information We use the collected information solely for the following business and legal purposes:

    • Service Delivery: To schedule, prepare for, and fulfill the requested notarial act or service (translation/apostille).

    • Legal Compliance: To record required entries in the Notary Public Journal in accordance with Missouri law.

    • Payment Processing: To process service fees and manage billing via our encrypted third-party payment processor (Stripe).

    • Client Communication: To request a review of services and ensure successful completion of the transaction.

    • Service Improvement: To analyze website usage (via analytics) to enhance our platform and client experience.

 

  • Data Sharing and Confidentiality As a single-notary operation, your information is generally only accessed by Sarah M. Kienzle (Swift Key Notary).

    • Payment Processing: All online payment information is encrypted and handled by Stripe. We do not have access to or store your credit card details.

    • Legal/Government Requests: We will only disclose personal information and document details when required by law, such as to respond to a subpoena, court order, or official request from government authorities (e.g., state or county entities for apostille processing).

    • Professional Services: Certain client data and documents must be shared when you request related services like apostille or translation. This data is shared exclusively for the purpose of fulfilling your order.

    • Confidentiality: We adhere to strict ethical and legal standards of confidentiality, including measures that meet HIPAA compliance expectations regarding the handling of sensitive information gathered during the execution of our duties. We do not share the content of conversations or documents beyond what is legally required.

 

  • Document Handling and Security Procedures

    • Notary Journal and Retention (Physical Documents)

      • Retention: Notary journals are physical records and are retained for 10 years after the date of the last entry, as required by Missouri state law.

      • Security: The physical notary journals are stored in a locked file cabinet within a secure residence.

      • Physical Document Handling: All physical documents transported for mobile notarial services are secured in a locked briefcase. Any temporary physical copies or drafts remaining in our possession will be shredded on the following Sunday after the service completion.

    • Electronic Document Handling

      • Notarized Documents (RON): Following a Remote Online Notarization session, the electronic document is available for immediate download by the client via the RON platform.

      • Un-notarized Documents: Un-notarized documents (such as drafts or supporting files) are deleted from our systems once the entire transaction has been completed and we have confirmed the customer has received their final copies.

      • RON ID Verification: All identity verification data, including images of valid ID and biometrics, is managed solely by the third-party Remote Online Notarization platform. We do not control or retain this specific data on our system.

    • Translation & Apostille Document Handling

      • Submission: Clients submit sensitive source documents (e.g., birth certificates, diplomas) by uploading them to an encrypted Jotform portal.

      • Internal Access: We access and download these files from the submission platform by logging in with an encryption key.

      • Disposal: All documents and details pertaining to a translation or apostille transaction will be permanently deleted and/or shredded on the last Saturday of the month following the transaction date. This timeline has been specifically set to allow sufficient time to ensure that all appropriate parties, including government agencies or foreign entities, have successfully received and processed the documents.

    • Data Security Measures We employ robust measures to protect your information:

      • All computer and online accounts, including scheduling and communication platforms, require two-factor authentication (2FA).

      • Payment processing is outsourced to Stripe, which encrypts your payment information, ensuring we never have access to your personal financial details.

      • Physical records (journals) are secured in locked cabinets within a private residence.
